1. General provisions
1.1. These Purchase and Sale Terms and Conditions (hereinafter referred to as the “Terms and Conditions”), accepted by the Buyer (after familiarizing themselves with the Terms and Conditions and checking the box next to the statement “I have read and agree to the terms and conditions of Beautyscandal.co.uk”), constitute a legally binding document for both parties, defining the rights and obligations of the Buyer and the online store (hereinafter referred to as the “Seller”), the terms and conditions of purchasing and paying for goods, the liability of the parties, the delivery and return policy, and other provisions related to the purchase and sale of goods in the Beautyscandal.co.uk online store.
1.2. The Seller reserves the right to change, modify, and supplement these Terms and Conditions. Changes made by the Seller are related to the requirements of applicable laws and do not contradict the principles of common sense.
1.3. By agreeing to these Terms and Conditions, the Buyer confirms that they are active and authorized to purchase goods in the Beautyscandal.co.uk online store.
2. Conclusion of the purchase and sale agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer, after adding items to their shopping cart, clicks the “Order” button in the online store.
2.2. Each agreement concluded between the Buyer and the Seller is stored in the Beautyscandal.co.uk online store’s database.
3. Buyer’s rights
3.1. The Buyer has the right to purchase goods in the Beautyscandal.co.uk online store according to these Terms and Conditions and the online store’s established procedures.
3.2. The Buyer has the right to return goods purchased in the Beautyscandal.co.uk online store by notifying the Seller in writing (by email: hello@beautyscandal.co.uk, indicating the desired item to be returned and the order number) no later than within 14 (fourteen) calendar days. Return conditions and other information are specified in section 9 of these Terms and Conditions – “Return and exchange of goods”.
4. Buyer’s obligations
4.1. The Buyer must pay for the goods and accept them according to the procedures established in these Terms and Conditions.
4.2. The Buyer undertakes not to transfer their login information to third parties. If the Buyer loses their login information, they must immediately inform the Seller using the contact information provided in the “Contacts” section.
4.3. If the information provided in the Buyer’s registration form changes, they must update it immediately.
4.4. When using the Beautyscandal.co.uk online store, the Buyer undertakes to comply with these Terms and Conditions, other conditions specified in the online store, and not to violate the laws of England and Wales.
5. Seller’s rights
5.1. If the Buyer fails to pay for the goods or breaches other obligations specified in these Terms and Conditions, the Seller has the right to terminate the agreement unilaterally.
5.2. The Seller has the right to suspend or terminate the operation of the online store at any time without prior notice.
6. Seller’s obligations
6.1. The Seller undertakes to sell the goods to the Buyer in accordance with these Terms and Conditions.
6.2. The Seller undertakes to protect the personal data of the Buyer according to the principles established by applicable laws.
7. Liability of the parties
7.1. The Parties shall be liable for breach of their obligations under these Terms and Conditions in accordance with the procedure established by applicable laws.
7.2. The Parties shall be released from liability for breach of their obligations under these Terms and Conditions if such breach was caused by force majeure circumstances that the Parties could not foresee or prevent.
8. Delivery of goods
8.1. Delivery of goods to the buyer’s specified address.
8.1.1. When ordering goods, the buyer undertakes to provide an accurate delivery address.
8.1.2. The buyer must accept the goods himself. If the buyer is unable to accept the goods and they are delivered to the address provided by the buyer and based on other information provided by the buyer, the buyer has no right to make any claims to the seller regarding the improper delivery of goods to the wrong person.
8.1.3. The goods are delivered by the seller or his authorized representative.
8.1.4. The seller delivers the goods within 2-4 days when the goods are in the seller’s warehouse and within 10-14 days when the goods are in the supplier’s warehouses. If the seller does not have the goods in stock and the supplier also does not have them in stock, then the seller refunds the money for the missing goods to the buyer.
8.1.5. The terms specified in paragraph 8.1.4 are preliminary and are not applicable in cases where the necessary goods are not available in the seller’s or supplier’s warehouses at the time. The seller is also not responsible for the Royal Mail post’s obligation to deliver the goods within 2-4 working days.
8.1.6. The buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the seller’s control. In such cases, the seller undertakes to contact the buyer immediately and agree on the conditions of delivery.
8.1.7. In all cases, when an order is placed, the customer is informed of the exact delivery time.
8.1.8. The seller is released from liability for the violation of delivery times if the goods are not delivered to the buyer or are not delivered on time due to the buyer’s fault or circumstances dependent on the buyer.
8.1.9. During the delivery of goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. When the Buyer signs the invoice (waybill) or other document for delivery-acceptance of the shipment, it is considered that the shipment has been delivered in good condition. If the Buyer notices that the packaging of the delivered shipment is damaged (crushed, torn, or otherwise externally damaged), he must note it in the invoice (waybill) or other document for delivery-acceptance of the shipment and, in the presence of the Seller or his representative, draw up a free-form act of shipment damage. If the Buyer fails to take these actions, the Seller is released from liability to the Buyer for any damage to the goods, if such damage was caused by packaging damage that the Buyer did not note in the prescribed manner above.
8.1.10. In cases where the Buyer notices that the shipment does not contain the appropriate set of goods or the provided goods are not of the appropriate size, color, or other dimensions, the Buyer must immediately inform the Seller about it.
8.1.11. In the case of a non-standard shipment, the Buyer is additionally informed about the exact delivery price.
9. Return and exchange of goods
9.1. Conditions for the return of goods of proper quality:
9.2. Goods of proper quality can be returned within 14 (fourteen) calendar days from the day of their delivery.
9.2.1. The returned item must be in its original, undamaged packaging.
9.2.2. The item must not be damaged.
9.2.3. The item must be unused and must not have lost its original appearance (changes to the packaging appearance, which were necessary to inspect the received item, are not considered essential changes to the appearance of the item).
9.2.4. The item must be complete.
9.2.5. The Buyer pays for courier services.
9.3. Conditions for the return of substandard goods:
9.3.1. Substandard goods can be returned within 14 (fourteen) calendar days from the day of their delivery.
9.3.2. The defects in the returned item were not caused by the fault of the Buyer.
9.3.3. The returned item is not complete.
9.4. In all cases of returning goods, a document confirming the purchase of the item must be provided.
9.5. Money for returned goods is transferred to the Buyer’s bank account.
10. Responsibility
10.1. The buyer is fully responsible for the accuracy of the information provided in the registration form. If the buyer provides inaccurate information in the registration form, the seller is not responsible for any resulting consequences.
10.2. The buyer is responsible for actions taken using the Beautyscandal.co.uk online store.
10.3. The buyer is responsible for sharing their login information with third parties. If a third party uses the services provided by Beautyscandal.co.uk while logged in with the buyer’s login information, the seller considers this person to be the buyer.
10.4. The seller is not responsible for any losses incurred if the buyer fails to familiarize themselves with these Terms and Conditions despite being given the opportunity to do so, and disregards the seller’s recommendations and obligations.
10.5. If there are links to other companies, institutions, organizations or individuals’ websites in the seller’s online store, the seller is not responsible for the information or activities on those websites, does not supervise or control those websites, and does not represent those companies or individuals.
10.6. In the event of damage, the party found to be at fault shall compensate the affected party for direct losses.
11. Final Provisions
11.1. These Terms are governed by UK laws and their provisions. All disputes arising from these Terms shall be resolved in an appropriate manner.
11.2. The Seller has the right to change or supplement the Terms at any time by notifying about it in the online store. The changes to the Terms will come into effect upon their publication in the online store.
11.3. The Buyer and the Seller agree that any disputes between them will be resolved through negotiations, and if such disputes cannot be resolved through negotiations, they will be resolved in courts as provided by UK law.
11.4. If the Buyer fails to provide a statement or provides an inadequate statement, the Seller has the right not to provide goods or services to the Buyer.
11.5. If any provision of the Terms is found to be illegal or invalid, it shall not affect the validity of other provisions and their implementation.
11.6. The Buyer’s and the Seller’s relationship is governed by the laws of the United Kingdom.
11.7. The terms used in the Terms have the meanings attributed to them by the Terms.
